Pas d'entente en vue de commettre le génocide des Tutsi ?

Le jugement en 1re instance du procès Militaires I, rendu par le Tribunal pénal international pour le Rwanda (TPIR) à Arusha le 18 décembre 2008, quoique condamnant trois des inculpés pour génocide, a fait crier victoire à leurs défenseurs en les relaxant de la charge d'entente en vue de commettre un génocide. S'il n'y avait pas d'entente en vue de commettre un génocide, il n'y avait pas, selon eux, de planification, donc pas de génocide du tout.

In its judgment at first instance in the Military I trial, the ICTR considers in particular that all the preparations for genocide "could clearly fall within the framework of a plan to commit genocide", but that "they could equally well enter into as part of a fight to defend political or military power in Rwanda." It persisted throughout the trial in distinguishing war from genocide, while the 1990 RPF attack was the result of the genocidal process that began in 1959, which forced many Tutsi into exile, and that in 1994, it was is the genocide that starts the war and not the other way around.
